This Acceptable Use Policy (“AUP”) governs use of Internet, network connectivity, hosting, cloud, virtual server, managed IT, cybersecurity, backup and disaster recovery, colocation network services, and other Fibernet Corp. (“FIBERNET”) services that provide access to or use of networks, systems, computing resources, storage, applications, Internet connectivity, or related infrastructure (collectively, “Services”).
This AUP is incorporated into the applicable customer agreement only to the extent the purchased Service is subject to it. Capitalized terms not defined here have the meanings assigned in the applicable Master Service Agreement (“MSA”) or Service Order. If this AUP conflicts with an executed Customer Agreement regarding a negotiated commercial or service-specific term, the Customer Agreement controls in accordance with its order-of-precedence provision.
1. PURPOSE AND RESPONSIBILITY
1.1 Purpose. This AUP is intended to protect FIBERNET, its customers, networks, systems, facilities, service providers, and the Internet community from unlawful, abusive, insecure, disruptive, or harmful use of the Services.
1.2 Relationship to MSA. General CLIENT responsibility for users, credentials, systems, security, and legal compliance is governed by the MSA. This AUP defines prohibited and restricted uses of applicable Services and FIBERNET’s technical response to abuse.
2. UNLAWFUL OR HARMFUL USE
CLIENT may not use, or permit use of, the Services in violation of applicable law or in a manner that materially facilitates unlawful or harmful activity.
- Using the Services to commit or materially facilitate fraud, theft, extortion, identity theft, unlawful harassment, threats, or other unlawful conduct.
- Storing, transmitting, distributing, or making available material where doing so violates applicable law or a binding court order.
- Using the Services to violate the intellectual-property, privacy, publicity, or other legal rights of another person or entity.
- Using the Services in connection with activity that creates a material and unreasonable risk to FIBERNET infrastructure, personnel, customers, service providers, or the public.
FIBERNET does not undertake to monitor all customer content or activity and does not assume responsibility for determining the legality of CLIENT content or business activities. FIBERNET may act on reasonably credible abuse reports, legal process, security information, or observed network activity as permitted by the Customer Agreement and applicable law.
3. NETWORK AND SYSTEM ABUSE
CLIENT may not use the Services to interfere with, disrupt, damage, probe without authorization, or obtain unauthorized access to networks, systems, accounts, devices, or data.
- Unauthorized access or attempted access to accounts, systems, servers, devices, networks, applications, or data.
- Unauthorized vulnerability scanning, port scanning, penetration testing, password attacks, credential stuffing, brute-force activity, or exploitation attempts against third-party systems.
- Launching, participating in, materially facilitating, or knowingly hosting command-and-control infrastructure for denial-of-service attacks, distributed denial-of-service attacks, botnets, malware, ransomware, or other malicious activity.
- Spoofing, forging, or materially falsifying packet headers, source addresses, routing information, sender identity, or similar technical information for deceptive or abusive purposes.
- Intentionally interfering with the availability, performance, integrity, or security of FIBERNET or third-party networks, systems, or services.
- Attempting to circumvent reasonable technical restrictions, rate limits, authentication controls, security controls, or service limitations.
Authorized security testing performed as part of a FIBERNET cybersecurity service or pursuant to documented authorization from the system owner is not prohibited by this Section when conducted within the authorized scope.
4. MALWARE AND COMPROMISED SYSTEMS
CLIENT may not knowingly use the Services to create, distribute, host, control, or facilitate malware, ransomware, spyware, credential-stealing software, malicious code, botnets, phishing infrastructure, or similar harmful technology, except for legitimate security research or cybersecurity services performed within a documented authorized scope.
If FIBERNET reasonably determines that a CLIENT system, device, account, website, virtual server, or other resource is compromised or is causing material harm, FIBERNET may require CLIENT to remediate the condition and may take temporary protective action as permitted by the Customer Agreement.
5. EMAIL, MESSAGING AND SPAM
CLIENT may not use the Services to send, facilitate, or support unsolicited bulk communications in violation of applicable law or generally accepted anti-abuse practices.
- Sending bulk commercial email or messages to recipients who have not provided legally sufficient consent where consent is required.
- Using purchased, harvested, scraped, generated, or otherwise improperly obtained recipient lists for abusive bulk messaging.
- Operating open mail relays, open proxies, or other systems that materially enable third-party spam or abuse.
- Using misleading sender information, deceptive subject lines, forged routing information, or other deceptive techniques.
- Continuing to send communications to recipients who have properly opted out where applicable law requires honoring the request.
Legitimate transactional messaging, customer communications, and lawful marketing are permitted when conducted in compliance with applicable law and reasonable industry practices.
6. PHISHING, IMPERSONATION AND DECEPTIVE ACTIVITY
CLIENT may not use the Services to host or transmit phishing pages, credential-harvesting systems, fraudulent login portals, deceptive domains, impersonation campaigns, or other content or infrastructure designed to deceive users into providing credentials, money, confidential information, or unauthorized access.
7. INTELLECTUAL PROPERTY AND ABUSE COMPLAINTS
CLIENT may not knowingly use the Services to infringe third-party copyrights, trademarks, trade secrets, or other intellectual-property rights.
FIBERNET may investigate reasonably credible infringement or abuse complaints and may request information or corrective action from CLIENT. FIBERNET may comply with valid legal notices and applicable statutory processes. Repeated or serious infringement may result in protective action or suspension as permitted by the Customer Agreement and applicable law.
8. HOSTING, CLOUD AND COMPUTE RESOURCE USE
For hosting, cloud, VPS, virtual server, storage, and similar shared or multi-tenant Services, CLIENT may not use resources in a manner that materially and unreasonably degrades the platform or interferes with other customers beyond the capacity or usage purchased by CLIENT.
Where a Service is subject to defined CPU, memory, storage, bandwidth, IOPS, connection, licensing, or other resource limits, CLIENT must operate within those limits. FIBERNET may require an upgrade, reconfiguration, traffic reduction, or other reasonable corrective action when usage materially exceeds the purchased Service or threatens platform stability.
Dedicated or expressly unmetered resources remain subject to security, legal, technical, and network-integrity requirements even where a specific usage quantity is not capped.
9. INTERNET AND NETWORK SERVICES
CLIENT may not use Internet or network Services in a manner that materially disrupts FIBERNET’s network, creates persistent abusive traffic, causes widespread blocklisting attributable to CLIENT activity, or materially impairs service to other customers.
CLIENT is responsible for applications and systems exposed to the Internet through CLIENT-assigned addresses. FIBERNET may use reasonable network-management and security measures to protect network integrity, mitigate attacks, respond to abuse, comply with law, or preserve availability.
10. CYBERSECURITY AND MANAGED SERVICES
Security tools, monitoring, vulnerability assessment, endpoint protection, managed detection, penetration testing, incident-response, and similar cybersecurity capabilities may only be used against systems, accounts, networks, applications, or data that CLIENT owns or is authorized to test, monitor, access, or protect.
CLIENT is responsible for obtaining any permissions required from its employees, users, customers, vendors, licensors, or other system owners before directing FIBERNET to perform security activities on their systems or data.
Nothing in this AUP creates a cybersecurity performance guarantee, incident-response time, detection guarantee, compliance certification, or other service level. Any such commitment must be expressly stated in the applicable Service Order or SLA.
11. BACKUP AND DISASTER RECOVERY
CLIENT may not use backup, replication, archive, or disaster-recovery Services to store or transmit content or data that CLIENT is not legally authorized to possess, process, copy, or retain.
Retention periods, storage quantities, recovery objectives, recovery procedures, and other backup or disaster-recovery commitments are governed by the applicable Service Order, service-specific terms, or SLA and are not established by this AUP.
12. COLOCATION AND CUSTOMER EQUIPMENT
Use of network connectivity, IP resources, hosted systems, or other networked resources associated with colocation remains subject to this AUP. Physical data-center operations, power, cooling, equipment, facility access, deliveries, Remote Hands, and related rules are governed by the applicable Data Center & Colocation Terms and Access Authorization rather than this AUP.
13. SECURITY AND ABUSE RESPONSE
13.1 Reports and Cooperation. CLIENT will reasonably cooperate with FIBERNET in investigating suspected abuse, compromise, security incidents, or violations associated with CLIENT Services. FIBERNET may request logs, contact information, remediation status, or other information reasonably necessary to investigate or mitigate the issue.
13.2 Technical Mitigation. Where FIBERNET reasonably determines that activity presents an immediate or material threat to security, network integrity, service availability, persons, property, or other customers, FIBERNET may use proportionate technical measures such as filtering or blocking traffic, null-routing an address, disabling a compromised account or interface, or isolating an affected resource. Suspension or termination of Services is governed by the MSA.
13.3 Notice. When reasonably practicable, FIBERNET will notify CLIENT of material technical mitigation taken under this Section. Emergency or security conditions may require action before notice.
13.4 MSA Remedies. Default, suspension, termination, payment, collection, and restoration of suspended Services are governed by the MSA.
14. ABUSE CONTACTS AND CUSTOMER CONTACT INFORMATION
CLIENT must maintain current administrative, technical, billing, and abuse/security contact information with FIBERNET where requested. CLIENT should promptly respond to material abuse or security notices concerning its Services.
Reports concerning suspected abuse of FIBERNET Services may be submitted to FIBERNET using the contact information published on fiber.net or through FIBERNET support channels.
15. CHANGES TO THIS AUP
The current version of this AUP will be posted on FIBERNET’s website. Any right to update this AUP, and the effect of an update on an existing customer relationship, are governed by the MSA and applicable law.
16. RELATIONSHIP TO OTHER DOCUMENTS
This AUP governs acceptable use of applicable FIBERNET Services. It does not establish pricing, payment terms, renewal terms, service levels, service credits, physical data-center access rules, private-suite occupancy rights, confidentiality obligations, indemnification, limitation of liability, or dispute procedures. Those matters are governed by the MSA, applicable Service Order, SLA, service-specific terms, Access Authorization, Private Colocation Suite Lease, or Privacy Policy, as applicable.
